Thank you for using [propertytraders.io)  (the Platform)! We want you to get the most out of the Platform, but it’s important to set some ground rules so that you understand what we don’t promise to do for you. Before you use the Platform, please make sure that you read and understand the below.

  • We are an introductory service

The Platform is a medium that facilitates the introduction between buyers, sellers, tenants, landlords, brokers and other agents for the purposes of buying, selling and renting property. The Platform simply collects a service fee in consideration for providing this introduction service and does not have any obligations or liabilities to, and is not a party to any contract between, any of the users of the Platform in relation to such services or otherwise resulting from the introduction.

Any terms and conditions relating to another user on the Platform constitute a contract between you and that user once agreed and do not involve us in any way.

  • you are using the platform at your own risk
    • You acknowledge and agree that you are using the Platform at your own risk. It is your responsibility to verify the identity of a user and conduct your own independent enquiries and assessments before deciding to engage with that user or relying on any information on the Platform. It is your responsibility to read a user’s terms, conditions and privacy policies before working with them. We will have no obligation to verify the identity or credibility of any user on the platform, or any information provided by a user on the Platform. We may provide links to third party individuals and companies on the Platform, but we do not control or endorse them. We also do not examine, determine or warrant the competence, solvency or information of any user on the Platform.
  • Privacy AND COMPLIANCE

When you use the Platform, you should be cautious when deciding what personal and/or information you display and provide to others. When you post information on the Platform, you acknowledge and agree that this will be visible by everyone. If you don’t feel safe providing your personal information on the Platform, use alternative contact details or do not use the Platform.

If you are collecting, using and disclosing personal and/or sensitive information from another user, you acknowledge and agree that you will comply with all privacy laws.

By using the Platform, you represent and warrant that you will comply with all laws, regulations and industry standards that apply.

  • DISPUTES
    • If you have a dispute with another user, you must direct your complaint or issue with that user. We will not be involved in any dispute between you and another user. You release us from all claims, demands, loss, liability, expenses and damage (whether direct or indirect) arising out of any dispute between you and another user.   • INFORMATION AND SECURITY

The Platform, and the information on the Platform, is made available to you strictly on an ‘as is’ basis. We do not guarantee that any information on the Platform is complete, accurate, true, or free from errors or defects. We do not accept responsibility for loss, interference or damage to computer systems, mobile phones or other electronic devices arising in connection with your use of the Platform. You should take your own precautions to ensure that the process you employ to access the Platform does not expose you to the risk of viruses, malicious computer code or other forms of interference (for example, worms or trojan horses).

  • CONTENT, RATINGS AND REVIEWS
    • Our Platform allows users to post information, including ratings and reviews. To the maximum extent permitted by law, we won’t be liable for any content or information posted by users on the Platform. We do not promise to screen all content on the Platform. However, we do reserve the right to remove any content that is inappropriate or breaching any laws.
    • If you are submitting a rating or review on the Platform, you represent and warrant that you are providing a true and honest rating or review of your experience with another user.
  • Liability and indemnities
    • (Limitation of liability) To the maximum extent permitted by applicable law, the Platform excludes completely all liability to any person for loss or damage of any kind, however arising whether in contract, tort (including negligence), statute, equity, indemnity or otherwise, arising from or relating in any way to the Platform or its use or any services provided by any user on the Platform. This includes the transmission of any computer virus.
    • (Disclaimer) All express or implied representations and warranties are, to the maximum extent permitted by applicable law, excluded.
    • (Consumer law) Nothing in this agreement is intended to limit the operation of the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth) (ACL). Under the ACL, you may be entitled to certain remedies (like a refund, replacement or repair) if there is a failure with the goods or services we provide.
    • (Indemnity) You agree to indemnify the Platform and its employees and agents in respect of all liability for loss, damage or injury which may be suffered by any person arising from you or your representatives’:
      • breach of any term of this agreement;
      • use of the Platform; or
      • your provision or receipt of services from another user.
    • (Consequential loss) To the maximum extent permitted by law, under no circumstances will the Platform be liable for any incidental, special or consequential loss or damages, or damages for loss of data, business or business opportunity, goodwill, anticipated savings, profits or revenue arising under or in connection with the Platform, this agreement or their subject matter, or any services provided by any service provider or user on the Platform (except to the extent this liability cannot be excluded under the Competition and Consumer Act 2010 (Cth)).
